By uploading photographs and any other images ("Photographs") to photohaat, you grant photohaat and its services on www.photohaat.com, a limited, royalty-free, non-exclusive, worldwide license to use, adapt, copy and display the photographs within the secure location set up for you on www.photohaat.com. |
Valid Membership
By submitting your registration form, you agree to accept the Terms and Conditions of Service. |
Fees
photohaat doesn’t charge any fee for membership. photohaat reserves the right to subsequently charge a fee for the storage of your photographs on the website and/or change the above storage limits in the future by giving user the reasonable notice on our website and/or via email. |
Storage Policy
photohaat provides the facility to its users to upload the images and photographs for free without any limitation in online storage space. The purpose of unlimited storage isn’t to provide an online storage warehouse. Usage that suggests this approach gets flagged by photohaat 's anti-abuse controls. photohaat reserves the right to take any action necessary against such flagged accounts including, but not limited to, storage limits, additional charges for storage or account deletion. |
Uploading
photohaat provides the facility to its users to upload images and photographs to their photo albums through the Internet. photohaat may offer from time to time other methods to upload photographs. You agree to comply with all conditions that photohaat may additionally impose in respect of any new uploading method. |
No Obscene or Infringing Material
You agree that you will not upload to photohaat any photographs which contain material that is unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane or indecent, including without limitation any transmissions that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, national or international law; or
• upload to photohaat any Photographs or any other information which contain material which violates or infringes upon the rights of others, including privacy, moral or publicity rights, copyright, trademark or other proprietary rights without first obtaining permission from the owner or right holder; or
• upload to photohaat any Photographs or any other information which contain material that contains viruses, worms, corrupted files, or any other form of corruptive code.
You understand that the material uploaded on photohaat in the form of Photographs or any other information is the responsibility of the person who uploaded it. photohaat has no obligation to monitor the content submitted. However, photohaat reserves the right to decide whether any material or content uploaded is prohibited or not and to remove any content or material that in photohaat’s sole discretion are objectionable or in violation of this terms and conditions stated in this Agreement. |
Orders
Quality of Prints
photohaat agrees to provide the best quality of prints. You agree that the quality of the prints will depend upon the digital files uploaded by you. Therefore, it is likely that for certain prints, the quality of the prints may not be satisfactory for which photohaat shall not be responsible.
Pricing of Prints
All the prices stated on our website are in Indian Rupees (INR). Taxes and shipping and packaging charges are inclusive.
Restricted reuse of service
You hereby acknowledge that you will not reproduce, sell, resell, duplicate, and copy any part of the service for any commercial purpose.
Cancellation of Order
During processing of your order or delivery, if the order placed doesn’t not fulfill these Terms and Conditions of Service, photohaat reserves the right to cancel the order. You will be notified about the action.
Delivery of Order
photohaat is committed to deliver your order within the specified time period. In case of delays in delivery due to unforeseeable and unavoidable reasons, photohaat shall not be held responsible. photohaat is not responsible for delivery at wrong address(es) if the address specified at the time of ordering is incorrect.
Credit card payment
photohaat agrees that it will not store any credit card information in our database without your permission. photohaat shall not be held responsible for any issues arising out of payment gateway dysfunction. |
Link to other websites
photohaat may provide links to other websites that are maintained by third parties. photohaat is not responsible and/or liable for any information available on these third party websites. |
Change in Terms and Conditions
photohaat reserves the right to modify or amend these terms and conditions of service for any reason by giving user the reasonable notice on our website and/or via email. Such modifications or amendments will be effective once the notice is served. |
Governing Law
This Agreement will be governed by and construed in accordance with the judiciary laws of the Republic of India without giving effect to any principles or conflicts of law. |
Termination of Agreement

• photohaat reserves the right to terminate your membership and remove all the content in your account for reasons, including, but not limited to:
o Violation of terms and conditions of service
o Violation of any governing policy or law |
Security
Any password and/or secret codes used for using services provided by photohaat are for your personal use and you are requested not to share these passwords and/or security codes with anybody else. You agree that it is your responsibility to keep these passwords and/or security codes confidential and you will be responsible for any act and/or statements originated from the misuse of these passwords and/or security codes. You agree to inform photohaat in the event of loss or theft of these passwords and/or security codes or misuse in any manner. |
Disclaimer
photohaat may suspend or cease the operation of the website for any reason with or without giving any prior notice.photohaat reserves the right to change the content on the website, and/or suspend or change the product or service offered by the website. You agree that in any mentioned case, you will use the website at your own risk and photohaatis not responsible for any loss or damage of your images or photographs. Hence, user is requested to keep proper backups of all the uploaded images or photographs. |
Limited Warranty
photohaat concedes to provide efficient, reliable, timely and satisfactory service to the best of its resources and skills.photohaat makes no warranty that the website will be uninterrupted, error free, and virus free or free from any malicious content. The Website is provided on an "as is where is" and "as available" basis. In any case of unsatisfactory service by photohaat, photohaat agrees to take proper corrective action on the basis of decision taken byphotohaat. |
Limitation of Liability
You agree that the uploading and/or storage of your images or photographs may be affected and/or interrupted by numerous factors beyond our control including, but not limited to the Internet, computer or utilities failure, natural calamities, unexpected acts of public, restraints by governmental authorities, strikes, war, riots, attacks of virus, corruptive code and crashing of website. In either case, photohaat shall not be liable to you for any loss or damage. You further agree that under no circumstances, including but not limited to negligence, shall photohaat or its affiliates be liable for any indirect or incidental damages that may result from the use of, or the inability to use the services offered by the Website. |
Refunds
If you are not satisfied with the quality of prints or service(s) offered, please contact our customer care atsupport@photohaat.com within two weeks of receipt. |
Feedback
You agree to report any abuse of these terms and conditions of service, or complaint at contact@photohaat.com. |
Indemnity/Compensation
You agree to indemnify/compensate photohaat and its affiliates, including its directors, employees, service providers, content providers, suppliers against any losses, claims or demand including legal fees, resulting from any violation of these Terms and Conditions of Service, or any wrongful activity related to your account by you or any other person using your account. |

Unless otherwise indicated, the copyright in the Website and its contents, including but not limited to the text, images, graphics, sound files, animation files, video files, and their arrangement, are the property of photohaat and are protected by copyright laws.
